By creating an account, purchasing a subscription, clicking to accept, or otherwise accessing or using the Services, you agree to these Terms.
Introduction
- Acceptance of These Terms
You may not access or use the Services unless you agree to these Terms. United States
- Nature of the Services
The “Services” include professional identity email addresses using the SpeechTherapy.com domain, related mailbox and account functions, account management tools, support functions, and any other product, feature, website, software, content, integration, or offering we make available now or in the future.
The Services are designed to support professional identity and communication. The Services are not represented as enterprise-grade, mission-critical, emergency, legal-hold, or guaranteed-delivery infrastructure.
- Related Policies
Your use of the Services is also subject to our Privacy Policy and Acceptable Use Policy, each of which is incorporated into these Terms by reference.
Privacy Policy: https://speechtherapy.com/privacy-policy
Acceptable Use Policy: https://speechtherapy.com/acceptable-use-policy/
If there is a conflict between these Terms and another publicly posted policy, these Terms control unless we expressly state otherwise in writing.
- Eligibility
You must be legally capable of entering into a binding agreement to use the Services. Unless we expressly allow otherwise in writing, you must be at least 18 years old to purchase a subscription or create an account in your own name. - Account Registration and Accurate Information
You must provide complete and accurate registration, billing, contact, and account information and keep it current. You must promptly update account details if they change. We may suspend or terminate an account, decline a username request, or refuse renewal if information is incomplete, inaccurate, misleading, or outdated. - Account Credentials and Security
You are responsible for maintaining the confidentiality of your password, login credentials, recovery methods, and connected devices. You are responsible for all activity occurring through your account, whether or not you authorized it, unless applicable law provides otherwise.
You must promptly notify us at support@speechtherapy.com if you suspect unauthorized access, credential compromise, phishing, or other security issues affecting your account.
- Responsibility for Use of the Account
You are responsible for all content sent, received, stored, routed, forwarded, posted, or otherwise transmitted through your account and for all acts and omissions of any person using your credentials or devices. You must use the Services only in compliance with these Terms and applicable law. - Usernames and Email Addresses Are Licensed, Not Owned
Any SpeechTherapy.com username, mailbox name, alias, routing identity, or email address made available through the Services is licensed to you on a limited, revocable, non-transferable, non-exclusive basis during an active, compliant subscription. It is not sold to you, not assigned as property, and not subject to ownership rights by you.
Your subscription gives you permission to use a designated address while these Terms remain in effect and your account remains eligible, paid, and compliant.
- Username Availability, Reservation, and Reassignment
We reserve the right, in our sole discretion, to reject, reserve, block, reclaim, suspend, rename, disable, or reassign any username, alias, or mailbox at any time for legal, security, operational, brand, reputational, impersonation, inactivity, abuse, payment, technical, or business reasons.
Reasons may include, by way of example, trademark concerns, impersonation risk, confusion with another person or organization, inactivity, account delinquency, suspected fraud, domain-reputation risk, policy violations, or operational restructuring.
We are under no obligation to keep a specific username available for you indefinitely, even if it was previously associated with your account.
- Shared-Domain Reputation Protection
You acknowledge that the Services operate on a shared domain and shared infrastructure. Misuse by one account can damage deliverability, inbox placement, trust, technical reputation, and the experience of other customers.
Because protecting the SpeechTherapy.com domain is essential to the Services and our mission, we may act quickly and without prior notice to investigate, throttle, block, quarantine, suspend, restrict, rename, or terminate accounts, messages, settings, forwarding behavior, aliases, or integrations that we believe may harm the domain, our providers, our systems, other customers, or third parties.
- Required Cooperation Regarding Abuse and Security
If we contact you about spam, phishing, malware, spoofing, unusual sending activity, compromised credentials, or other domain-risk concerns, you must promptly cooperate with reasonable verification, remediation, and security steps. We may require password resets, disabling of forwarding, deletion of messages, disabling of integrations, or other corrective measures as a condition of continued use.
- General Acceptable Use Commitment
You may not use the Services for unlawful, fraudulent, deceptive, abusive, harmful, or otherwise prohibited purposes. You may not use the Services in a way that interferes with our operations, degrades performance, harms others, or creates risk for the SpeechTherapy.com domain or any third-party provider. - No Spam or Unapproved Bulk Email
You may not use the Services to send spam, unsolicited bulk email, duplicative email, mass outreach, mailing-list traffic, newsletters, cold outreach, or other high-volume or campaign-based communications without our prior written permission.
The Services are intended primarily for person-to-person professional communications, not for bulk-email marketing, list management, or mass-delivery operations.
- No Fraud, Phishing, or Impersonation
You may not use the Services to impersonate another person or organization, misrepresent affiliation, create deceptive sender identities, engage in phishing, attempt credential harvesting, solicit sensitive information under false pretenses, run scams, or support fraud or social engineering. - No Automated Abuse, Scraping, Warming, or Deliverability Testing
You may not use bots, scripts, scrapers, automation tools, seed lists, warming tools, deliverability-testing tools, reputation-manipulation tools, or other systems to simulate human engagement, probe spam filtering behavior, harvest information, create accounts in bulk, or circumvent anti-abuse controls. - Third-Party Clients, Forwarding, and Integrations
You may use supported email clients, connected applications, forwarding rules, and integrations only in a manner consistent with these Terms. We may disable or restrict forwarding, API access, protocols, integrations, client connections, or connection methods if they create security, privacy, compliance, or domain-reputation risk.
You are responsible for the security and behavior of any third-party client, device, extension, plugin, app, forwarding target, or integration connected to your account.
- Provider Limits and Operational Controls
We and our providers may impose limits on sending, receiving, storage, bandwidth, connections, attachment size, login attempts, forwarding, retention, aliases, rules, or other usage. Such limits may change without notice.
We may block, defer, or reject messages or activity that exceed limits or that appear automated, suspicious, excessive, or abusive, even if you believe the activity is legitimate.
- Monitoring, Investigation, and Enforcement
We may investigate suspicious or prohibited activity and may review logs, metadata, routing information, authentication events, abuse complaints, provider notices, sending patterns, and other operational information as reasonably necessary to protect the Services, the domain, users, providers, and third parties, or to comply with law.
We are not obligated to monitor all activity, but we may do so where reasonably necessary to operate and protect the Services.
- HIPAA and Regulated Data Disclaimer
The Services are not represented as HIPAA-compliant, are not intended for the transmission or storage of protected health information (“PHI”), and are not offered with a business associate agreement (“BAA”).
You must not use the Services where HIPAA compliance, a BAA, or another regulated-security framework is required unless and until we expressly offer such a product in a separate written agreement. The fact that the domain name references the speech-language pathology profession does not mean the Services are appropriate for PHI, medical records, or other regulated health data.
- Third-Party Providers and PolarisMail
The Services rely on third-party providers and infrastructure, which may include PolarisMail, hosting providers, DNS providers, security vendors, payment processors, registrars, and other service providers. We do not control all aspects of those third-party systems.
We are not responsible for outages, filtering decisions, suspensions, routing behavior, security incidents, delays, data loss, message rejection, vendor policy changes, or other failures caused in whole or in part by third-party providers.
- Service Availability and No Service-Level Agreement
The Services are provided on an “as available” basis. We do not promise uninterrupted access, continuous uptime, guaranteed availability, fixed maintenance windows, guaranteed recovery objectives, or any service-level agreement unless we expressly agree otherwise in a separate written contract signed by an authorized representative of SpeechTherapy.com LLC.
No third-party provider SLA or uptime commitment is incorporated into these Terms or passed through to you.
- Deliverability Disclaimer
Email is inherently dependent on third-party networks, servers, spam filters, authentication systems, recipient settings, and provider policies. We do not guarantee that any message will be sent, accepted, routed, delivered, received, read, or acted upon.
A message appearing in your “Sent” folder does not mean it reached the intended recipient. Messages may be delayed, rejected, quarantined, filtered, rate-limited, bounced, silently dropped, or otherwise made unavailable.
- Best-Effort Support
We will use commercially reasonable efforts, in our discretion, to provide customer support, but support is offered on a best-effort basis only. We do not guarantee response times, resolution times, issue escalation, continuous staffing, weekend or holiday coverage, or support for third-party devices, apps, plugins, forwarding destinations, or unsupported configurations.
We may prioritize abuse, billing, security, and operational-risk matters over general support requests.
- Your Backup and Data Responsibility
You are solely responsible for maintaining independent backups and records of any important emails, attachments, contacts, settings, or other data. Do not rely on the Services as your sole archive or sole method of preserving information.
We may lose, delete, corrupt, fail to store, fail to retain, or fail to make available messages or data, whether due to provider behavior, account status, system changes, user error, security events, or other causes.
- Subscription Plans and Billing Cycles
We may offer monthly subscriptions, annual subscriptions, promotions, trials, or other billing structures. The price, billing cadence, included features, and renewal terms for your plan will be presented at checkout or in your account.
Fees are payable in advance unless we state otherwise.
- Automatic Renewal Authorization
By purchasing a subscription, you authorize SpeechTherapy.com LLC and its payment processors to charge your selected payment method on a recurring basis for the applicable monthly or annual term, plus applicable taxes and other disclosed charges, until you cancel.
Each renewal charge will occur automatically unless canceled before the next renewal is processed.
- Checkout Disclosures and Affirmative Consent
You agree that we may require affirmative consent at checkout, including by checkbox, button click, or similar electronic action, acknowledging recurring billing, automatic renewal, no-refund terms, licensed-not-owned usernames, and acceptance of these Terms and our related policies.
Electronic assent and electronic records are sufficient to form and evidence your agreement.
- Cancellation Process
You may cancel automatic renewal through the billing portal or by emailing support@speechtherapy.com. Our FAQ or help materials may provide step-by-step cancellation instructions, but those materials do not replace these Terms.
To avoid the next renewal charge, your cancellation request must be completed before that renewal is processed. Cancellation stops future renewal charges only.
- No Refunds or Prorations
Except where required by applicable law, all fees are non-refundable and non-prorated. We do not provide refunds or credits for partial billing periods, unused time, unused storage, unused features, suspended accounts, terminated accounts, renamed usernames, rejected messages, filtered email, or downtime.
If you cancel after a charge is processed, your cancellation will apply to future renewals only.
- Price Changes, Taxes, and Billing Changes
We may change prices, plans, features, storage limits, or billing structures at any time. For material pricing changes affecting an existing paid subscription, we will generally provide reasonable advance notice through the website, billing portal, account email, or another reasonable method.
You are responsible for applicable taxes, duties, and similar charges, except taxes based on our net income.
- Failed Payments and Delinquency
If a charge is declined, reversed, disputed, or otherwise fails, we may retry payment, suspend features, downgrade service, restrict usage, disable sending or receiving, or terminate the account. We may require an updated payment method before restoring service.
Delinquent accounts may lose access to mailboxes, aliases, forwarding behavior, settings, and connected features. We have no obligation to restore a delinquent account, preserve its contents, or hold a username pending payment.
- Changes to the Services
We may add, remove, replace, suspend, discontinue, redesign, patch, upgrade, downgrade, migrate, or otherwise modify any aspect of the Services at any time, with or without notice.
Nothing in these Terms guarantees that any feature, function, interface, storage amount, provider, routing method, integration, user experience, or subscription plan will remain available in its current form or at all.
- Changes to the Mission
SpeechTherapy.com supports the speech-language pathology profession through scholarships and other mission-driven initiatives. However, the existence, timing, amount, eligibility, administration, funding level, frequency, continuation, or nature of any scholarship, charitable activity, educational initiative, community program, or other mission-related effort may change, be suspended, or be discontinued at any time in our sole discretion. - Changes to These Terms
We may modify, amend, replace, supplement, or discontinue these Terms at any time. Changes may become effective immediately for legal, security, fraud-prevention, operational, or technical reasons. For other material changes affecting existing subscribers, we will generally provide reasonable advance notice through the website, billing portal, or email associated with your account.
Your continued access to or use of the Services after revised Terms become effective constitutes acceptance of the revised Terms. If you do not agree to revised Terms, your sole remedy is to discontinue use and cancel your subscription before the revised Terms become effective.
- Scholarship and Mission Disclaimers
Subscription fees are fees for Services, not charitable donations. No portion of any subscription payment is earmarked for any specific scholarship recipient, educational institution, charitable initiative, or funding level unless we expressly state so in a separate written commitment signed by an authorized representative.
Nothing in these Terms creates a contractual obligation for us to continue any scholarship program, maintain any award amount, or use subscription revenue in any particular way.
- Suspension and Termination
We may suspend, restrict, disable, rename, quarantine, or terminate your access to all or part of the Services immediately, with or without notice, if we believe, in our sole discretion, that:
(a) you violated these Terms or another policy;
(b) your account creates or may create domain-risk, provider-risk, legal-risk, security-risk, or reputational-risk;
(c) payment failed or your account is delinquent;
(d) continued service is impractical, unlawful, or operationally inadvisable;
(e) your account is inactive for an extended period; or
(f) we are discontinuing the relevant service, feature, plan, or offering.
Upon termination, your right to access and use the Services immediately ends. We may delete or permanently disable your mailbox, aliases, data, and settings without liability.
- Intellectual Property and Brand Features
The Services, websites, software, design, trademarks, names, logos, text, graphics, workflows, and other materials we provide are owned by or licensed to SpeechTherapy.com LLC and are protected by applicable intellectual property laws.
Except for the limited rights expressly granted in these Terms, no rights are transferred to you. You may not use our trademarks, logos, or branding without our prior written permission.
- Disclaimers and Limitation of Liability
To the fullest extent permitted by law, the Services are provided “AS IS” and “AS AVAILABLE,” and SpeechTherapy.com LLC disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, title, accuracy, quiet enjoyment, uninterrupted service, security, data preservation, or guaranteed deliverability.
To the fullest extent permitted by law, SpeechTherapy.com LLC and its officers, managers, members, employees, contractors, agents, affiliates, licensors, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages, or for any loss of profits, revenue, goodwill, reputation, data, messages, business opportunities, or business interruptions, arising out of or relating to the Services, even if advised of the possibility of such damages.
To the fullest extent permitted by law, SpeechTherapy.com LLC’s total aggregate liability arising out of or relating to an account, the Services, or these Terms will not exceed five hundred U.S. dollars (US $500).
These limitations apply regardless of the theory of liability and form an essential basis of the bargain between you and us.
- Indemnification
You will defend, indemnify, and hold harmless SpeechTherapy.com LLC and its officers, managers, members, employees, contractors, agents, affiliates, licensors, and service providers from and against any claim, demand, dispute, investigation, liability, loss, damage, judgment, settlement, penalty, fine, cost, and expense, including reasonable attorneys’ fees, arising out of or relating to:
(a) your use of the Services;
(b) your content or communications;
(c) your violation of these Terms, the Privacy Policy, or the Acceptable Use Policy;
(d) your violation of law or third-party rights; or
(e) fraud, abuse, impersonation, spam, phishing, or other misconduct connected to your account. - No Reliance
You acknowledge that your decision to use or purchase the Services is based only on the express promises contained in these Terms and any written subscription details presented by us at checkout.
You have not relied on any statement, advertisement, social media post, FAQ, blog post, interview, webinar, presentation, support communication, or other representation that is not expressly incorporated into these Terms.
- Entire Relationship
These Terms, together with the Privacy Policy, Acceptable Use Policy, and any written subscription terms presented during checkout, constitute the entire agreement between you and SpeechTherapy.com LLC regarding the Services and supersede prior or contemporaneous understandings on that subject.
No employee, contractor, volunteer, ambassador, reseller, customer-support representative, scholarship recipient, FAQ, social media post, marketing statement, or informal communication may modify these Terms or create additional obligations unless expressly stated in a written agreement signed by an authorized representative of SpeechTherapy.com LLC.
- Assignment, Transfer, and Business Transactions
We may assign, transfer, delegate, or otherwise dispose of our rights or obligations under these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, sale of assets, financing, reorganization, or transfer of the Services.
Your account, data, username status, subscription, and related rights may be transferred to a successor or affiliated entity as part of such a transaction, subject to applicable law.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
- Force Majeure
SpeechTherapy.com LLC is not liable for any delay, interruption, failure, degradation, or inability to perform caused by circumstances beyond our reasonable control, including acts of God, natural disasters, pandemic, labor disruptions, war, terrorism, riots, civil disturbances, utility failures, internet failures, provider failures, cyberattacks, security incidents, government orders, legal process, or supply-chain interruptions. - Electronic Communications, Notices, and Records
You consent to receive communications from us electronically, including by email, website posting, account notification, billing portal notice, or other electronic means. Legal notices to us must be sent to support@speechtherapy.com and to our mailing address listed above.
You agree that electronic records and electronic assent may be used to document your acceptance of these Terms, your subscription, your payment authorization, your cancellation, and other account actions.
- Informal Dispute Process
Before filing a lawsuit, each party agrees to provide the other party with written notice of the dispute and a 30-day opportunity to attempt informal resolution. Your notice must be sent to support@speechtherapy.com and to our mailing address. Our notice to you may be sent to the email address associated with your account or another contact method reasonably associated with your account.
The notice must include the sender’s name, contact information, relevant account information, a description of the dispute, and the relief requested.
- Governing Law, Courts, and Small Claims Exception
These Terms and any dispute arising out of or relating to the Services or these Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules.
Except for eligible claims brought in a court of competent small-claims jurisdiction, any legal action arising out of or relating to the Services or these Terms must be brought exclusively in the state or federal courts located in Dallas County, Texas, and each party consents to personal jurisdiction and venue in those courts.
Either party may bring an eligible individual claim in a court of competent small-claims or justice-court jurisdiction if that forum is available under applicable law.
- Claim Deadline, Interpretation, and Severability
To the fullest extent permitted by law, any claim arising out of or relating to the Services or these Terms must be filed within one year after the claim arose or be permanently barred.
If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. Headings are for convenience only and do not affect interpretation. Our failure to enforce a provision is not a waiver.
